Speeding
Speeding tickets can be charged under three (3) different Statutes: Florida Statute 316.183, Florida Statute 316.187 and Florida Statute 316.189. The police officer is permitted to determine your speed by Radar, Vascar, Laser, Aircraft or Pace Clock. Any speeding ticket involving the citizen driving 15 or less miles per hour over the speed limit can result in three (3) points being assessed against one’s driver license. Any speeding ticket involving the citizen driving 16 or more miles per hour over the speed limit is can result in three (3) points being assessed against one’s driver license. Any speeding ticket 30 miles per hour or more over the speed limit will be heard by a Judge rather than a Hearing Officer. There can be many defenses to a speeding infraction including lack of documentation.
