Violations of Probation (VOP)
When a citizen is placed on probation, he or she is required to comply with all of the terms and conditions that are imposed. Any violation will almost always result in an Affidavit of Violation of Probation being filed and the Judge issuing a Warrant (usually No Bond). VOP Hearings only require the State to prove the violations by a preponderance of the evidence rather than beyond a reasonable doubt, hearsay is allowed with limited exceptions, and the Defendant can be required to testify. If found in violation, the Judge can sentence the citizen to significantly more punishment than what was originally imposed including but not limited to substantial jail or prison time.
